Welcome to the Ice Diamonds website, located at https://icediamonds.co.il/ (hereinafter: "the Website"), operated by Venus Import and Marketing (hereinafter: "the Website Management").
The Website serves as an e-commerce platform for purchasing products offered to the general public.
The information and/or use of the Website and/or browsing the Website are subject to the terms, limitations, and responsibilities detailed below.
The user confirms that they are aware that the Website Management may change/update the terms of use from time to time, and they are obligated to review the terms of use at the time of purchase, before and as a condition for making a purchase – making a purchase will constitute explicit consent to the terms of use as detailed below.
The terms detailed below are in addition to the terms detailed alongside each product, as specified on the Website itself, and in any case of contradiction between what is stated on the Website and what is detailed below, the provisions of the terms of use will prevail, as detailed above and below.
The Website Management may change the prices and/or products offered by it and/or change the range of services and/or benefits.
The information appearing on the Website is directed and intended for Website users and applies to both men and women.
The use of the masculine form is for convenience only.

Acceptance of Terms of Use

The Website user confirms that they have read the terms of use, and by using the information and/or browsing the Website, the Website user accepts the terms detailed in the terms of use, above and below, without exception.
It should be emphasized that the purchase of benefits and/or products and/or ordering services and/or redemption of benefits detailed on this Website is limited to those who are 18 years old or older, and by performing these actions, the performer declares that they are 18 years old or older.
Website users declare that it is clear and known to them that the information appearing on the Website is updated from time to time and therefore old information and/or information that is not completely up-to-date should not be relied upon.
The Website Management reserves the right to inform the user that a certain action and/or product purchase and/or redemption of promotions and benefits are not available or cannot be redeemed, at any given time, for any reason, and this will not establish any claim by the user for reliance on the information on the Website.
The information appearing on the Website does not constitute an offer to the general public, and only the completion of the purchase through the Website and receipt of confirmation of its execution will bind the parties, all subject to the terms of use above and below.
It is the user's responsibility to examine the special conditions for redeeming each purchase and/or offered service, including the specific special conditions appearing next to each product. No claim by a Website user will be heard that they were unaware of the conditions where the conditions were published on the Website, and it is presumed that the user was aware of them and approved them at the time of purchase.
In any case of contradiction between what is stated in the terms of use and what is stated in any other way on the Website, including through advertising, by the Website Management regarding the services and/or benefits published on the Website, the provisions of the terms of use will prevail.

Use of the Website

It is clarified that the Website will be open and available 24 hours a day and that it will be possible to purchase products offered on the Website every month of the year and every day of the week, including Friday and Saturday, as well as holidays and vacations, all subject to the supplier's terms and policy.
A Website user shall not publish or transmit through the Website any material that infringes in any way upon the rights of others or any unlawful, threatening, offensive, misleading, abusive, defamatory, repulsive, intrusive/violating privacy, vulgar, crude, obscene or otherwise objectionable material, that encourages criminal behavior, creates a civil wrong and/or otherwise violates any law and/or regulation and/or which contains any advertising or solicitation for any products or services, without the express written prior consent of the Website Management.
It should be emphasized that the sale of products on the Website will be at a pre-determined price until the stock runs out, subject to the specific sale details and subject to the terms of use below and above.
For a transaction subject to VAT, the price displayed on the Website will include VAT.

Product Delivery Policy

A product purchased on the Website will be delivered within up to 2 business days, subject to the shipping company's policy, via home delivery at a cost starting from 49 ILS, depending on the products purchased.
To remove any doubt, it is clarified that products purchased together on the Website will be delivered on the same date or close to it, each product will be delivered according to the aforementioned delivery period.
Orders can be placed for any region in the country, subject to the shipping company's policy.

"Business day" – Sunday to Thursday, excluding general holidays, holiday eves, and days when banks in Israel are closed.

Copyright

It is clarified that the copyrights of this Website belong to the Website Management, which uses them according to authorization from the rights holders, all in accordance with the Copyright Law, 2007, and the copyright laws valid in Israel.
Copyrights include all text, images, illustrations, audio clips, video clips, music, software applications, and graphics, characters, and products offered for sale to the browsing public (hereinafter: "the Protected Material").
A Website user may make fair use of the material on the Website, and in any case, not make commercial use of the Protected Material. It is clarified that fair use includes reasonable citation from the material.

The website user acknowledges that they will bear sole and full responsibility for the manner in which they use the products purchased on the website.
The website management and/or the rights holders of the website will not be liable for any damage caused to the website user or any third party as a direct or indirect result of using a product purchased on the website. The limitation of liability detailed above will apply to the website management and/or the rights holders of the website and/or their employees and/or anyone on their behalf.
The website management and/or the rights holders of the website will not be liable for illegal activity and/or activity contrary to the terms of use of the website, by website users or any other party not under its full control.

Privacy Policy

The Website Management reserves the right to request details from a Website user as part of the product purchase process on the Website, including full name, email address, and mobile phone number, for the purpose of verifying the purchaser's identity, sending marketing materials, and updating various benefits that will be offered to Website users regularly.
It should be emphasized that failure to provide details by the Website user, if requested, may prevent the completion of a transaction, and the decision on this matter is reserved.
Since the Website is in an online environment where absolute information security is not possible, any user who provides details on this Website does so at their own risk. However, the Website will make reasonable and customary efforts to maintain the confidentiality of user information.

A Website user who submits a complaint regarding specific products/services/benefits will be considered as having authorized the transfer of their personal details, as recorded on the Website, to the relevant party for the purpose of investigating their complaint. Cancellation Policy

Cancellation of product orders by a club member will be carried out in accordance with the provisions of the Consumer Protection Law, 1981 (hereinafter: "the Law") and the Consumer Protection (Cancellation of Transaction) Regulations, 2010 (hereinafter: "the Regulations") and in accordance with the Website's policy as published on the Website and as updated from time to time. Without derogating from the foregoing, it is clarified as follows:
Cancellation of a transaction will be made with the Website Management, and it is agreed that the cancellation date will be the date on which the notice was delivered to the Website Management, through the contact option on the Website or via email.

A Website user may cancel the transaction within the cancellation period as defined in Section 14c(c) of the Law (hereinafter: "the Cancellation Period"), after which the transaction cannot be canceled.

Partial cancellation of a transaction is not possible, and in any case where a Website user wishes to exercise only part of the transaction, they must cancel the entire transaction subject to the conditions detailed above and below and place a new order.

Cancellation due to defect or non-conformity –

In the event of a transaction cancellation within the cancellation period, due to a defect or non-conformity, and after receiving notification thereof from the website user, the website management will ensure the refund of the amount paid by the user within 14 days from the date of receipt of the cancellation notice.
Where a product has been supplied, the website management will ensure the refund as stated in this section only after the website user has returned the product, notified the website management in writing, and the product has reached the website management.

Cancellation of transaction, within the cancellation period, not due to defect or non-conformity –

A user may cancel a transaction not due to a defect or non-conformity, under the following cumulative conditions:
The cancellation is made subject to the provisions of the terms of use and within the cancellation period.
The user has presented the original purchase invoice.
The product value is greater than 50 ILS.
The product has not been damaged and the user has not made any use of it (including connecting to electricity).
The product is returned to the Website Management in its original, complete, undamaged, and fault-free packaging.
Shipping fees will be borne by the Website user even if the product was not delivered to them but was handed over to the shipping company.

Consequences of Transaction Cancellation

The Website Management will contact the user and act, subject to the terms of use, to refund them, within 14 days from the date of receiving the product, the amount paid by them for the product, minus a cancellation fee of 5% of the transaction amount or 100 ILS, whichever is lower.

Cancellation of the transaction by the company

Without derogating from the provisions of these regulations, in any of the following cases, the company shall be entitled to disqualify a user's offer and/or cancel the order and/or engagement with the user, even if a notice of the user's win was published on the website or a notice thereof was sent to the user. A disqualified offer and/or canceled engagement will not entitle the user to any remedy and the user will have no claims against the company:

In the event of a good-faith error in one of the data specified on the website regarding the product, including the product price or its description, on the basis of which the order was placed and/or in the event that the user's offer was below the minimum price.

In the event of a shutdown or malfunction in the proper operation of the website due to "force majeure" and/or, due to a significant malfunction in the computer system, telephone system or other communication systems serving the company, and/or in any other case where factors and/or events beyond the company's control delay, prevent or disrupt the proper operation of the website or the supply of products.

In the event that the user failed to fulfill any of their obligations, including, but not limited to, the obligation to pay for the product ordered and/or in any case where the user provided incorrect and/or inaccurate and/or incomplete details, including in the event of non-approval of the transaction by the credit card company.

Warranty Terms

We undertake to provide our customers with new, undamaged, and carefully packaged products. Our warranty covers the integrity of the product upon its arrival to the customer, meaning – the condition of the product as delivered in its original packaging. In case of a defect or damage caused during shipping, it must be reported immediately upon receipt of the product.

Most of our products arrive unassembled in a sealed package, and the customer is required to perform the assembly themselves. The warranty does not cover the assembly process, errors in assembly, or damages that may result from incorrect assembly or improper use of the product. Furthermore, no warranty will be given for components that have been damaged, broken, or worn out after opening the packaging.

Our warranty refers only to the stage between the product leaving us and its delivery to the customer in its original packaging. Any change in the product's structure, self-repair, improper assembly, or use contrary to the manufacturer's instructions – are not covered by the warranty. We recommend checking all parts before starting assembly and ensuring that all components are present and complete.

Miscellaneous

The law applicable to the activities on the Website and these terms of use is Israeli law only. Exclusive and sole jurisdiction to hear any claim and/or request that may be filed in connection with the terms of use of this Website is granted to the competent court in Tel Aviv District.
The invalidity of one or more of the above terms of use shall not affect the validity of this entire contract. An invalid or unenforceable term shall be replaced by a valid term that is as close as possible to the original term it replaces, as far as legally possible.

Reading the above terms of use constitutes a basic condition for using and/or browsing and/or purchasing products for Website users. A Website user who uses, purchases products, and/or redeems benefits, if offered on the Website from time to time, hereby confirms that they have read the terms of use in their entirety, that the terms are understood by them, and that they accept the terms contained therein without any reservation.
